# SHOM PET CARE ## BOARDING & PET CARE TERMS AND CONDITIONS --- These Terms and Conditions ("Agreement") apply to all services provided by Shom Pet Care ("Shom Pet Care", "we", "us", "our") to the pet owner ("Owner", "you", "your") and the pet(s) listed in the Booking Form ("Pet" or "Pets"). By signing this Agreement and leaving your Pet in our care, you confirm that you have read, understood, and agree to the following: --- ## 1. BOOKINGS & ADMISSION 1.1. Admission of any Pet is at the sole discretion of Shom Pet Care. 1.2. Owner confirms that all information provided in the Booking Form and any medical history provided to Shom Pet Care is true, complete, and accurate. 1.3. Owner must inform Shom Pet Care of any known medical conditions, allergies, behavioural issues (including aggression, biting history, anxiety, or escape attempts), dietary restrictions, and any current medications. 1.4. Owner must disclose if the Pet has ever bitten or injured any person or animal, or displayed aggressive behaviour. --- ## 2. HEALTH & VACCINATIONS 2.1. Owner confirms that the Pet is up-to-date with all vaccinations recommended by a qualified veterinarian for boarding in this region, including but not limited to: - Dogs: Rabies, Distemper, Parvovirus, Leptospirosis, Kennel Cough (Bordetella) - Cats: Rabies, FVRCP (Feline Viral Rhinotracheitis, Calicivirus, Panleukopenia) 2.2. Owner must provide valid vaccination records before admission. Shom Pet Care may refuse admission if vaccination proof is not provided. 2.3. Owner confirms that, to the best of their knowledge, the Pet is free from any contagious or infectious disease at the time of check-in. 2.4. Owner understands and accepts that, even with reasonable precautions, boarding facilities can expose pets to stress, infections, parasites, and other illnesses. --- ## 3. SENIOR PETS (9 YEARS AND OLDER) 3.1. For the purposes of this Agreement, any Pet aged 9 years or older is considered a senior pet. 3.2. Owner understands that senior pets have a significantly higher risk of health complications, including but not limited to: - Organ failure (heart, kidney, liver, respiratory system, etc.) - Breathing difficulties or respiratory distress - Seizures, strokes, or neurological events - Cardiac arrest or heart failure - Sudden collapse or death - Complications from arthritis, diabetes, or other age-related conditions which may occur without warning, especially in a boarding environment due to stress, change in routine, or underlying health conditions. 3.3. By boarding a senior pet (9+ years) with Shom Pet Care, Owner: - Expressly acknowledges and accepts all risks associated with boarding a senior pet, including illness, health deterioration, injury, and death; and - Agrees that Shom Pet Care shall not be held liable or responsible in any way for any illness, deterioration in health, medical emergency, or death of a senior pet, except to the limited extent required by applicable law and only in cases of our proven gross negligence or intentional misconduct. 3.4. Owner agrees that boarding of all pets aged 9 years or older is undertaken at the Owner's sole risk. 3.5. Shom Pet Care strongly recommends that owners of senior pets obtain a veterinary health check-up within 7 days prior to boarding to confirm the Pet is fit for boarding. --- ## 4. BITING, AGGRESSION & ANIMAL BEHAVIOUR 4.1. Owner must fully disclose any history of biting, aggression, reactivity, or violent behaviour in the Pet before admission. 4.2. Owner understands that pets, regardless of their temperament at home, may behave unpredictably in a boarding environment due to stress, unfamiliar surroundings, presence of other animals, or other factors. 4.3. Risk of Biting Incidents: - Pets may bite other animals, staff members, or third parties during their stay. - Pets may be bitten or injured by other animals in the facility. 4.4. Owner understands and accepts that: - Shom Pet Care takes reasonable precautions to prevent aggressive incidents, but cannot guarantee that biting or fighting will not occur. - Shom Pet Care shall not be held liable for any injury, illness, or death of the Pet resulting from biting incidents, fights, or interactions with other animals, except in cases of our proven gross negligence or intentional misconduct. 4.5. If the Pet causes injury to any person, staff member, or other animal: - Owner shall be fully responsible for all medical costs, veterinary costs, damages, legal fees, and compensation claims arising from such incident. - Owner agrees to indemnify and hold Shom Pet Care harmless from any claims, lawsuits, damages, or liabilities arising from the Pet's behaviour. 4.6. Shom Pet Care reserves the right to: - Separate or isolate any Pet showing signs of aggression or anxiety. - Refuse group play or interaction for safety reasons. - Immediately require the Owner to collect the Pet if it poses a danger to staff, other animals, or itself. --- ## 5. ACCIDENTAL DEATH, ILLNESS & UNFORESEEN EVENTS 5.1. Owner understands and acknowledges that death of a pet can occur suddenly and unexpectedly, even in healthy-appearing animals, due to causes including but not limited to: - Heart attack, cardiac arrest, or heart failure - Stroke or brain haemorrhage - Respiratory failure or choking - Anaphylactic shock or severe allergic reaction - Seizures or epileptic episodes - Bloat (gastric dilatation-volvulus) in dogs - Organ failure (kidney, liver, etc.) - Undiagnosed or pre-existing medical conditions - Stress-induced complications - Accidental injury (falls, collisions, entanglement) - Ingestion of foreign objects - Reactions to environmental changes - Complications during feeding or medication administration - Fights or altercations with other animals - Escape attempts resulting in injury - Natural causes or old age - Any other unforeseen medical emergency 5.2. Shom Pet Care is NOT a veterinary clinic or hospital. We provide boarding, daycare, and general pet care services only. We do not have veterinary doctors, medical equipment, or emergency surgical facilities on-site. 5.3. While Shom Pet Care is committed to providing the best possible care for your beloved pet, Owner understands and agrees that: - Shom Pet Care cannot prevent all illness, injury, or death. - Shom Pet Care shall not be held liable or responsible for accidental death, sudden illness, medical emergencies, or death from any cause, except in cases of our proven gross negligence or intentional misconduct. - Shom Pet Care shall not be held responsible for death occurring due to pre-existing, undiagnosed, or underlying health conditions, whether known or unknown to the Owner. 5.4. Owner expressly acknowledges that: - Pets are living beings with complex health needs. - Even with the highest standard of care, unforeseen medical events can occur. - Shom Pet Care cannot be expected to predict, prevent, or be responsible for all health events. --- ## 6. COMMON ILLNESSES, INJURIES & MEDICAL TREATMENT 6.1. Owner understands that, even in a well-managed facility, Pets may develop: - Fever or elevated temperature - Cough, cold, kennel cough, or respiratory infection - Skin problems, including rashes, itching, hot spots, or fungal infections - Vomiting, diarrhoea, or gastrointestinal upset - Eye or ear infections - Minor injuries (scratches, cuts, sprains, abrasions) - Stress-related symptoms (loss of appetite, lethargy, anxiety) - Parasites (fleas, ticks, worms) despite preventive measures due to stress, environment, interaction with other pets, or pre-existing/underlying conditions. 6.2. If your Pet shows signs of minor or common illness, Shom Pet Care may, at its discretion: - Provide basic first aid and comfort care - Monitor the Pet closely - Contact a veterinarian for advice - Arrange for your Pet to be examined and treated by a veterinarian 6.3. Veterinary Care Authorization Owner authorizes Shom Pet Care to seek veterinary care for the Pet if we, in our sole judgment, consider it necessary for the health and welfare of the Pet. This includes emergency veterinary treatment if the Owner cannot be reached. 6.4. Costs of Veterinary Treatment Owner agrees to be fully responsible for all veterinary fees, medications, hospitalization costs, surgery costs, transport costs, and related expenses incurred for the Pet's treatment, whether for minor illness, routine care, or emergency care. 6.5. Shom Pet Care shall not be held responsible for any illness, injury, or health condition that develops during or after the boarding period. --- ## 7. PRE-EXISTING CONDITIONS & UNDISCLOSED HEALTH ISSUES 7.1. Owner must disclose all known health conditions, medical history, ongoing treatments, and medications before admission. 7.2. Owner understands that: - Pets may have undiagnosed, latent, or hidden health conditions that may manifest or worsen during boarding. - Stress from being away from home can trigger or aggravate medical issues. - Shom Pet Care cannot detect all health conditions and is not responsible for undiagnosed conditions. 7.3. Shom Pet Care shall not be liable for any illness, injury, deterioration, or death resulting from pre-existing conditions, undisclosed conditions, or undiagnosed conditions, regardless of when symptoms first appear. --- ## 8. ASSUMPTION OF RISK & RELEASE OF LIABILITY 8.1. Owner understands and voluntarily accepts that there are inherent risks in boarding, daycare, grooming, and group play for pets, including but not limited to: - Illness (including contagious and non-contagious diseases) - Injury from self-harm, other pets, or the environment - Biting incidents (being bitten or biting others) - Escape or running away - Stress, anxiety, depression, or behavioural changes - Aggravation of existing health problems - Allergic reactions - Sudden or unexpected illness - Accidental death - Death from natural causes 8.2. Owner voluntarily assumes all such risks on behalf of themselves and their Pet. 8.3. To the maximum extent permitted by applicable law, Owner: - Releases, waives, and discharges Shom Pet Care and its owners, directors, employees, representatives, contractors, and agents from any and all claims, demands, actions, or causes of action for loss, damage, injury, illness, or death to the Pet or property, arising out of or in connection with the services provided, except in cases of Shom Pet Care's proven gross negligence or intentional misconduct; and - Agrees not to bring or participate in any claim, lawsuit, or legal action against Shom Pet Care arising from such events, except where such waiver is not permitted by law. 8.4. This release and waiver applies to all claims, whether known or unknown, anticipated or unanticipated, at the time of signing this Agreement. --- ## 9. LIMITATION OF LIABILITY 9.1. To the maximum extent permitted by applicable law, Shom Pet Care's total liability for any and all claims arising out of or relating to the services provided, whether in contract, tort, negligence, or otherwise, shall be limited to the lesser of: - The total amount of boarding/service fees actually paid by the Owner for the specific booking during which the incident occurred; or - A maximum of INR 5,000 (Indian Rupees Five Thousand Only). 9.2. Under no circumstances shall Shom Pet Care be liable for: - Any indirect, consequential, incidental, special, punitive, or exemplary damages - Emotional distress, mental anguish, or sentimental value of the Pet - Loss of companionship - Loss of profit, income, or business - Any damages claimed by third parties - Veterinary costs exceeding the limitation amount above 9.3. Owner agrees that the limitations set forth in this section are fair and reasonable given the nature of boarding services and the fees charged. --- ## 10. OUR COMMITMENT TO YOUR PET 10.1. Shom Pet Care is dedicated to providing the best possible care for your beloved pet. We treat every pet in our care with love, attention, and respect. 10.2. Our standard of care includes: - Clean, safe, and comfortable boarding facilities - Regular feeding according to your instructions - Fresh water available at all times - Supervised exercise and playtime - Regular monitoring of health and behaviour - Prompt attention to any signs of illness or distress - Immediate contact with Owner or emergency contact if concerns arise - Seeking veterinary care when necessary 10.3. While we cannot guarantee the prevention of all illness, injury, or death (as explained in this Agreement), we promise to care for your pet as if it were our own family member. --- ## 11. BEHAVIOUR, SAFETY & FACILITY RULES 11.1. Owner must inform Shom Pet Care if the Pet has any history of: - Biting or attacking humans or other animals - Aggressive behaviour, reactivity, or resource guarding - Escape attempts or destructive behaviour - Severe separation anxiety - Fear of loud noises, other animals, or specific triggers 11.2. Shom Pet Care may separate, isolate, or refuse certain activities (such as group play, outdoor exercise, or grooming) if a Pet shows aggression, severe anxiety, or any behaviour that may be unsafe. 11.3. Shom Pet Care reserves the right to: - Use muzzles, crates, or other safety equipment if necessary for safety - Terminate boarding immediately if a Pet poses a danger - Refuse future bookings for pets with behavioural issues 11.4. Owner is responsible for any damage or injury caused by their Pet to: - Other animals - Staff members or visitors - Property, furniture, or equipment and agrees to indemnify and hold Shom Pet Care harmless from any related claims, costs, damages, legal fees, or liabilities. --- ## 12. EMERGENCY PROCEDURES 12.1. In case of a medical emergency: - Shom Pet Care will attempt to contact the Owner and emergency contacts immediately. - If the Owner cannot be reached, Shom Pet Care is authorized to seek emergency veterinary care. - All costs of emergency care shall be borne by the Owner. 12.2. In case of death of a Pet: - Shom Pet Care will make reasonable efforts to inform the Owner or emergency contact as soon as possible. - If requested and feasible, Shom Pet Care may assist in arranging veterinary examination or post-mortem at the Owner's cost. - Shom Pet Care may arrange for appropriate storage of remains until the Owner provides instructions. - Owner agrees that Shom Pet Care shall not be liable for any costs, damages, or claims related to the Pet's death, except as required by law in cases of proven gross negligence or intentional misconduct. 12.3. Owner must provide accurate emergency contact information and ensure at least one contact is reachable during the boarding period. --- ## 13. PERSONAL PROPERTY 13.1. Owner may leave personal items (beds, blankets, toys, collars, leashes, bowls, clothing, etc.) at their own risk. 13.2. Shom Pet Care is not responsible for loss, damage, destruction, or theft of any personal items left with the Pet. 13.3. We recommend not leaving valuable or irreplaceable items. --- ## 14. ABANDONMENT 14.1. If the Owner fails to collect the Pet on the agreed check-out date and does not contact Shom Pet Care to arrange an extension and payment: - Shom Pet Care will attempt to contact the Owner and emergency contacts. - If there is no response within 7 (seven) days, the Pet may be treated as abandoned. - Shom Pet Care may take reasonable steps in accordance with applicable law, including re-homing the Pet through an animal shelter or rescue organization. 14.2. Owner remains liable for all fees, costs, and expenses incurred up to the date the Pet is collected or re-homed. 14.3. Shom Pet Care shall not be liable for any claims arising from the re-homing of an abandoned Pet. --- ## 15. PAYMENT, CANCELLATIONS & REFUNDS 15.1. Fees, deposits, and payment terms will be as stated in Shom Pet Care's current price list or Booking Form. 15.2. Full payment or deposit (as applicable) is required before or at the time of check-in. 15.3. Cancellation and refund policies will be as stated in the Booking Form or on our website and may be updated from time to time. 15.4. No refund will be provided if the Pet is collected early, the Pet is asked to leave due to behavioural issues, or the Pet becomes ill or passes away during the stay. --- ## 16. PHOTOGRAPHS & MEDIA 16.1. Owner agrees that Shom Pet Care may take photographs, videos, or other media of the Pet during their stay. 16.2. Owner grants Shom Pet Care permission to use such images for business purposes, including marketing, advertising, social media, website content, and promotional materials, without compensation to the Owner. 16.3. If Owner does not wish for images to be used publicly, Owner must request this in writing before the start of the boarding period. --- ## 17. CHANGES TO TERMS 17.1. Shom Pet Care reserves the right to update or modify these Terms and Conditions at any time. 17.2. The Terms and Conditions in effect at the time of booking shall apply to that booking. 17.3. Continued use of our services after any changes constitutes acceptance of the updated Terms and Conditions. --- ## 18. SEVERABILITY 18.1. If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. 18.2. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the parties. --- ## 19. ENTIRE AGREEMENT 19.1. This Agreement, together with the Booking Form and any other documents expressly incorporated by reference, constitutes the entire agreement between the Owner and Shom Pet Care. 19.2. This Agreement supersedes all prior oral or written understandings, representations, or agreements relating to the services provided. --- ## 20. GOVERNING LAW & DISPUTE RESOLUTION 20.1. This Agreement shall be governed by and construed in accordance with the laws of India. 20.2. Any dispute arising under or in connection with this Agreement shall first be attempted to be resolved amicably through good-faith discussions between the parties. 20.3. If no resolution is reached within 30 (thirty) days, disputes shall be submitted to the exclusive jurisdiction of the appropriate courts in India, as determined by applicable law. 20.4. Owner agrees to bear their own legal costs in any dispute, unless a court orders otherwise. --- ## 21. By signing this Agreement, you acknowledge that you understand and accept these risks. > > We strongly recommend that all pet owners, especially those with senior pets (9+ years) or pets with known health conditions, consult with their veterinarian before boarding. --- This document should be reviewed by a qualified legal professional in your jurisdiction before use.
